Accounting and registration obligations

Delivery Policies

• In-house deliveries in all over Bangladesh, in which FeniSaleCenter.com is the service provider, usually take 3-5 business days. In other cases, products purchased from FeniSaleCenter.com, where there is a vendor, will be directly delivered by the supplier and may take around 5-7 working days.
• Delivery charges across Bangladesh are standard, although additional charges may apply based on product category, weight, and dimensions.

Quality Control

• To ensure an excellent customer experience, we often perform quality control over the orders sent on our end, from order processing, product packaging, local delivery, and after-sales service.
• FeniSaleCenter reserves the right to cancel any order that does not meet quality control standards. In this case, FeniSaleCenter will notify the customer of their order status.

Terms and Conditions for Cash on Delivery

• Cash on delivery is applicable for orders above 1000BDT and under 50000BDT.
• Processing and handling fees for all cash-on-delivery orders are 50BDT.
  • (This excludes additional charges based on product specifications.)
    • (This fee is non-refundable)

• Cash-on-delivery orders are to be executed in 3-5 business days.
  • At any stage, FeniSaleCenter reserves the right to cancel the placed order.

• Customers can reschedule their delivery up to 3 times before the order is subject to cancellation.
  • FeniSaleCenter reserves the right to refuse delivery if the customer abuses the rescheduling mechanic.

• The Cash on Delivery financing alternative is only valid for selected items.
  • Pre-delivery, FeniSaleCenter reserves the right to cancel any orders using the financing option.

Credit Card Use Policy

• You acknowledge that all credit card information provided is correct and accurate and that you have the authority to use said credit card for any transaction on FeniSaleCenter.com. You also accept that the provision of falsified information can lead to account termination.
• FeniSaleCenter will not disclose your personal credit card information to any third party unless required by law.
• FeniSaleCenter.com is not responsible for any credit card misuse or fraud. The responsibility for using a fraudulent card lies with you, and the responsibility for “proving the opposite” lies solely with you.

Fraudulent /Declined Transaction

• FeniSaleCenter has the right to reclaim the cost of products, collection costs, and legal expenses from those who use the site fraudulently. FeniSaleCenter also reserves the right to terminate a user’s account if signs of fraudulent and malicious activity appear.
• If FeniSaleCenter finds that the customer used a false e-mail, ID, or payment method to prompt a transaction, the said order becomes annulled, and the user account is subject to immediate termination. If the user in question hasn’t registered, FeniSaleCenter reserves the judgment to deny them entry to the website.
• FeniSaleCenter reserves the right to temporarily suspend credit card payments given probable cause, i.e., repeated refusal by the payment gateway or incorrect information. FeniSaleCenter also reserves the right to prosecute users for malicious exploitation of the site and any other illicit conduct, acts, or violations that breach the abovementioned terms and conditions.

Orders Subject to Canceled Transactions

• Orders placed due to falsely advertised images are subject to immediate cancelation.
• Orders placed due to falsely advertised descriptions are subject to immediate cancelation.
• Orders placed due to falsified vendor identity are subject to immediate cancelation.
• FeniSaleCenter reserves the right to cancel any order if discovered that falsification of information or identity is prevalent.

Transactional Limitations

FeniSaleCenter will not allow order placements in the following situations.

• Multiple payment refusals (3 per day)
  • Upon the 3rd refusal, FeniSaleCenter will temporarily suspend the credit/debit card payment method for 24 hours.

• Credit/debit cards must have a valid expiration date.
• Credit/debit cards used for order placement must be from GCC-compliant banks.

Shipping policies

FeniSaleCenter calculates shipping costs based on the following criteria.

• Package size, weight, dimensions, or by product category.
• Mode of transportation, such as land, air, sea, and train.
• The location from where you are shipping (city, state, country)
• The site to where you are shipping (destination country)
  • FeniSaleCenter currently only ships in Bangladesh and cannot be held responsible for any tariffs, taxes, customs, or clearance fees applied if a product is bought and delivered outside Bangladesh.

Defective Deliveries

• If any item with a valid warranty is delivered defective or not in working condition, you can notify FeniSaleCenter by e-mail or using the LiveChat option on the website. Our delivery team will then reach out to you and collect the product. FeniSaleCenter will then thoroughly examine the product.
  • If the product passes the inspection test, FeniSaleCenter will return the product to the customer.
  • If the product fails the inspection test, a refund will be issued and processed in 7-14 business days.
  • FeniSaleCenter reserves the right to inspect the product for a few days until their investigation concludes. FeniSaleCenter also reserves the right to keep product status during inspection secret.

• Repeated defective enquires that pass the inspection test will result in a temporary account suspension. Furthermore, the customer will be ineligible for COD and warranty extensions.
  • FeniSaleCenter reserves the right to terminate a user’s account or deny them service if found that they are manipulating the return function.

FeniSaleCenter Maintenance

You agree to all of the following terms listed below:

• Once a maintenance request is submitted, you will be assigned a ticket detailing when FeniSaleCenter will receive the product. Once inspection and repairs are complete, we will notify you about your product.
• You have about 60 days to collect the product before our engineers dispose of it. During collection, you must have a receipt or any digital proof signifying that you are the authorized individual there for the delivery.
• All products for inspection, maintenance, and analysis are sent with the owner’s permission.

• The user grants FeniSaleCenter and its engineers permission to alter, maintain, and modify their work.
• The user acknowledges that FeniSaleCenter is not responsible for any loss of data.
• The user acknowledges that the product warranty only covers the manufacturer’s defects. FeniSaleCenter does not consider other types of physical damage and tampering.

• The user acknowledges that sending a product for maintenance incurs NON – REFUNDABLE charges. The user agrees to pay for the inspection, collection, delivery, and hardware replacement. FeniSaleCenter will waive some or all of these charges if the product is still in warranty.

Digital communication

• Anytime you use the live chat function or ask a question on FeniSaleCenter.com, you communicate with us digitally. In tandem, our replies, notifications, alerts, and legal disclosures are also available to you digitally.
• As a user, you recognize that all relevant information is easily accessible while using the website. You also acknowledge and agree with the terms and conditions prevalent in digital communication.

You Confirm and Agree

• Given the instance. that a product is delivered to the wrong address due to invalid details provided by the customer. FeniSaleCenter will apply additional charges for redelivery.

  • If FeniSaleCenter finds you guilty of such acts, they have full right to terminate your account and press charges.

Returns and Cancellations

Refunds within (7) days of receiving item/s

If you have received a product and want to return it for reasons other than the product being defective, you have up to one week (7 days) from the date of receiving it. The guidelines for the return are as follows:

• Products that are part of bundle deals must have all items returned.

Refunds after (7) days of receiving an item/s

• Unless the product is defective, returning the product may not be possible in the case of some individual sellers. Customers can request FeniSaleCenter to contact the seller to arrange perhaps a return of products, but if the seller does not wish to accept, the return will not happen.
• FeniSaleCenter is not responsible or liable for return product requests not being accepted. The user acknowledges that when they purchase any product, they know the policies attached to the purchase.

Cancellation via FeniSaleCenter.com

• FeniSaleCenter reserves the right to cancel and deny orders at its discretion. Although, such practices are uncommon and heavily discouraged.
• FeniSaleCenter may ask for additional verification and information before and after accepting any order. Buyers will be notified via e-mail if orders are canceled or rejected.

Customer cancellation

• FeniSaleCenter reserves the right to process and approve orders at its discretion. Given that an online order is processed and approved, any orders already shipped are noncancellable.
• FeniSaleCenter will refund canceled products still under process in 7 to 14 days. (Coupons and wallet cards are exempt from refunds.)

Seller cancellation

• FeniSaleCenter’s customer care will deal with orders canceled by sellers. Representatives will then offer alternatives/reparations for the unfulfilled order.

• Products with liquid damage, physical damage, and malware are

• Warranty is only covered in the case that there is a

  packaging will not be eligible for warranty claims.
• Original invoices are required before any warranty claims can be
  made.
• Pre-Owned and Refurbished products may have a variable warranty
  ranging from 3-6 months.
• FeniSaleCenter cannot be held liable for product life after the
  warranty period.

Guarantee and Warranty Policies.

• Since FeniSaleCenter harbours a diverse mix of vendors, the customer must review the policies of each vendor they plan to buy from since some may offer longer or shorter warranties/guarantees.
  • FeniSaleCenter.Com is not liable for warranty and guarantee offerings on the website.
  • As the user, you are solely responsible for informing yourself of the policies before placing an order. Users can notify FeniSaleCenter customer care for further investigative action if there is a false advertisement on the website.

Governing Law and Jurisdiction

• The following agreement is governed and interpreted per the law of Bangladesh. FeniSaleCenter will arbitrate any disputes of legal substance amongst stakeholders. Their decision will be binding on other stakeholders. In the case of arbitration, disputes, or purchase claims, the governing and diagnosis follow e-commerce laws.

Indemnity

• You acknowledge to protect, compensate, and hold FeniSaleCenter and its stakeholders non-objectionable from and against any damages and claims (including attorney fees) arising from your actions or inactions which may have resulted in loss or detriment to FeniSaleCenter or its 3rd party suppliers. Your acknowledgment further extends to recognize that the following compensations consider any breaches, including but not limited to warranties, intellectual property, malpractice, defamation, violation of rights, and privacy. (This clause survives all expirations and terminations.)

Comment, Feedback, and Review Policies

• All reviews, comments, wishlists, and other consumer data submitted, whether disclosed or non-disclosed, posted on FeniSaleCenter.com, belongs to FeniSaleCenter. Information otherwise supplied in response or feedback to specific products, features, and services is also the property of FeniSaleCenter.
• Since FeniSaleCenter retains all the rights to the aforementioned intellectual property, they are not limited to its commercial use. Hence, FeniSaleCenter reserves the right to alter freely, adapt, reuse, reproduce, disclose, create, publish, and distribute all intellectual property without moral or legal obligations.
• The user acknowledges that their comments can be held in contempt against them should a circumstance present itself.

Further breaches that are harmful to other users or illegal may result in prosecution within Bangladesh. Currency Transaction

DISCLAIMER

FeniSaleCenter reserves the decision to cancel any order under the following conditions:

• Unverifiable information pertains to all information that FeniSaleCenter cannot verify in person for COD and online orders.
• Bank concerns about user identity: If a user’s bank account displays unusual activity, the bank may block purchases and inform FeniSaleCenter to cancel the order.
• Repeating offender for the following

• o Payment rejections: Repeated declines for credit/debit cards
• o Repeated redelivery scheduling: If the customer continuously updates their delivery location, FeniSaleCenter can refuse their order.
• o Unauthorized purchase: If FeniSaleCenter is informed that an unauthorized user made the purchase, FeniSaleCenter will cancel the order.

• Out-of-stock product: FeniSaleCenter may initially accept an order but later reject it due to unavailable stock.
• Defective product: If products pre-delivery are found in an unsatisfactory condition, FeniSaleCenter will cancel the delivery.

User Agreement

• Given that any part of this agreement is invalid or unenforceable, FeniSaleCenter will consider a replacement that evaluates all previous provisions and revises and reiterates all the terms and conditions previously stated. The remainder of the agreement will remain valid and enforceable until considered nonbinding.
• FeniSaleCenter does not insure warranty, product quality, value, and durability claims. These are products and services sold by 3rd party vendors and re-sellers. At any point, you cannot hold FeniSaleCenter liable for damages pertaining to the abovementioned terms. FeniSaleCenter, in these cases, only serves the role of a marketplace intermediary connecting sellers and buyers. FeniSaleCenter does not assume responsibility for omissions or inaccuracies made by 3rd parties and re-sellers. As a user, you may discover inconsistencies and inform FeniSaleCenter for further clarification or rectification, but any objectionable or misleading information that warrants additional caution can be directly reported.
  • o Regardless of the information’s authenticity, please exercise safe trade techniques.
• Sellers at FeniSaleCenter must adhere to benchmarks set by the website. False advertising, manipulation, and unsecured trading techniques are prohibited. If any seller is guilty of such crimes, their account can be terminated, along with their person facing prosecution.
